Welcome to Fork Yeah. These Terms of Service ("Terms") govern your access to and use of the Fork Yeah mobile application and website (collectively, the "Service"), operated by Fork Yeah ("we", "us", or "our"). By downloading, installing, or using the Fork Yeah app, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
You must be at least 13 years of age to use Fork Yeah. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to terminate accounts of users we reasonably believe to be under 13.
To access certain features of Fork Yeah, you will need to create an account. You agree to:
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable notice where practicable.
You may delete your account at any time directly within the Fork Yeah app via the Settings menu. Upon deletion, your account and associated personal data will be removed from our systems within 30 days, except where retention is required by applicable law. Forklores you have made public may be retained in anonymised or aggregated form for the purpose of maintaining Fork Factor ratings integrity, unless you request their removal prior to deletion.
Fork Yeah allows you to create, upload, and share content including photos, restaurant reviews, ratings, and other dining memories (collectively, "Forklores" and "Content"). By submitting Content to the Service, you:
You agree to use Fork Yeah only for lawful purposes and in a manner consistent with these Terms. You must not post, upload, or share Content that:
Violation of these rules may result in content removal, account suspension, or permanent termination at our sole discretion.
Fork Yeah is committed to maintaining a respectful community. We provide in-app tools that allow you to report Content you believe violates these Terms, and to block other users. We review reports and take appropriate action, which may include removing Content or suspending accounts. To report a concern or abusive content, use the in-app reporting feature or contact us at tech@forkyeah.app.
The Fork Factor is a community-powered restaurant rating system built from the collective Forklores of Fork Yeah members. By sharing a Forklore, you understand that your ratings and review data may contribute to Fork Factor scores displayed to other users. Fork Factor scores are aggregated and do not constitute our endorsement of any restaurant. We reserve the right to adjust the Fork Factor algorithm at any time to maintain accuracy and fairness.
All content, features, trademarks, logos, and software comprising the Fork Yeah Service — including the Fork Yeah name, Forklore and Fork Factor branding — are owned by or licenced to Fork Yeah and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or exploit any part of the Service without our express written permission.
Fork Yeah may integrate with or link to third-party services (such as mapping or restaurant data providers). These third-party services are subject to their own terms and privacy policies. We are not responsible for the practices or content of any third-party service, and your use of such services is at your own risk.
Your use of Fork Yeah is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your data as described therein.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Restaurant information displayed within the app is user-generated and we make no representations as to its accuracy or completeness.
To the fullest extent permitted by applicable law, Fork Yeah and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
You agree to indemnify, defend, and hold harmless Fork Yeah and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your Content, or your violation of these Terms.
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine in our sole discretion violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service and delete your account at any time. Provisions of these Terms that by their nature should survive termination will do so, including sections on intellectual property, disclaimers, indemnification, and limitation of liability.
We may update these Terms from time to time. When we make material changes, we will notify you within the app and update the "Last Updated" date at the top of this page. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Fork Yeah operates, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
